The HIPAA Privacy Rules mark this nation’s first set of comprehensive standards to ensure patient privacy and confidentiality. We, as a health care provider, are subject to the requirements of the HIPAA Privacy Rules. Uses/Disclosures of PHI Related to Communication Follow-Up, Services, or Health Care Operations

The law permits us to use and/or disclose PHI to carry out communication follow-up with users regarding care or service, and other health care operations. When we disclose PHI information, we work to only disclose that PHI which is minimally necessary to ensure proper and timely service and/or follow-up.

 

An example of when we might use/disclose your PHI for communication purposes is when the medical/health information you provided on the “Request Additional Information” form is needed by another CVH professional to properly discuss services, insurance and answer your questions.

 

Uses/Disclosures of PHI When An Authorization Is Not Required

In some cases, the law permits us to use and/or disclose PHI without requiring you to sign an Authorization. In many cases, these types of uses and/or disclosures are permitted to promote the government’s need to ensure a safe and healthy society. In other cases, the law does not require an Authorization because it would be impracticable to require an Authorization. The law also permits us to use/disclose PHI for certain specific purposes, where we are not required to obtain your advance written Authorization. Whenever doing so, we are committed to ensuring that we meet the necessary prerequisites before using/disclosing your PHI for those purposes, and to not use/disclose more of your PHI than is otherwise required/permitted under the law.

 

The law recognizes that there are certain instances where using and/or disclosing PHI, without first requiring an Authorization, would not unduly intrude upon a user’s rights to privacy and confidentiality, and where it would be too administratively burdensome to require an Authorization. An example is when the use and/or disclosure of PHI is made would be to the user (himself or herself), or to a personal representative of the user (family member or physician) inquiring about services, products or information.

 

There are several types of instances where the law permits us to use/disclose PHI in good faith, and consistent with the requirements of the HIPAA Privacy Rules and other laws. Sometimes, emergency circumstances may dictate our need to use/disclose PHI without obtaining an Authorization, to avert communicable or spreading diseases; for public health activities; for federal intelligence, counter-intelligence and national security purposes; to properly assist law enforcement to carry out their duties; when a judge or administrative tribunal order the release of such PHI; to help apprehend criminals; to assist armed forces personnel and operations; for military service, veterans affairs separation/discharge matters; for coroner/medical examiner purposes; for health oversight purposes (such as when the government requests certain information from us); to assist victims of abuse, neglect or domestic violence; for FDA-related purposes; for certain health and safety purposes; to help determine veterans eligibility status; to protect Presidential and other high-ranking officials; and to correctional institutions/law enforcement officials acting in a custodian capacity.

 

In those cases, although an Authorization is not required, we will attempt to provide you with the opportunity to verbally or otherwise agree/object to the use/disclosure, to the extent required by the HIPAA Privacy Rules.

 

Uses/Disclosures When An Authorization Is Required

For other types of uses and/or disclosures of PHI, the law requires us to obtain what is known as an Authorization. An Authorization can be revoked by you at any time, as long as we have not already reasonably relied on it to make a particular use and/or disclosure.

 

Information CVH Gathers Through the Site

We may gather two basic types of information through the website: “Personal Information,” or information, from which an individual can be identified, and “Aggregate Information,” or information from which an individual cannot be identified.

 

I. Aggregate Information - When you visit and interact with the website, CVH and third parties with whom CVH has contracted to provide services to CVH, may collect anonymous information from three sources: (a) server log files, (b) cookies, and (c) “pixel tags.”

 

a. Server Log Files: Your Internet Protocol (IP) address is an identifying number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number may be identified and logged automatically in our server log files whenever you visit the website, along with the time(s) of your visit(s) and the page(s) that you visited. We may use the IP addresses of all users to calculate website usage levels, to help diagnose problems with the website servers, and to administer the website. We may also use IP addresses to communicate with or to block access by users who fail to comply with our Terms & Conditions.
